Rules applicable to Builders

I have booked one flat 5 years ago in Ahmedabad. I paid all the money by cheque. Yet builder has yet not given possession and asking three lacs more to complete the pending work. I have only allotment letter as document. Should I go for legal action? Kindly suggest. more

Wait for a few more days. RERA will come into effect from 1st May 2017. Keep your Allotment Letter very carefully and take a couple of colour xeroxes of the same. According to RERA, all projects which are not completed on 1st May 2017 will automatically fall under its Jurisdiction. After that you need to wait for the RERA Regulator to be appointed in Gujarat (if not done already). Then take your complaint to him in the required format. The RERA Regulator will have NO OPTION BUT TO FILE A CASE AGAINST THE DEVELOPER. THE RERA RULES ARE VERY STRICT - PROBABLY THE DEVELOPER WILL HAVE TO GO TO JAIL !! If you wish, you can intimate the Builder of your intentions, to put pressure on him to complete the work without the additional charge which he is asking for. more  
Hi SAURABH PANDYA, {Sorry all legal professionals, } Mr Saurabh , See in india if you go to advocate he will do nothing just make you mad. I already gone all this thru. So what i suggested to Mr Pratap Singh Chauhan is apply to you. Write a letter that Dear Builder I made all the payment Annx added (give all the statement with date wise and total amount is paid) I was promised that delivery of flat on month of may 2016 but still after giving all the amount I have not received the possession, Kindly take this letter as Legal notice and reply me with a date for possession with in 15 days 15 days is legal no need for 1 month notice that is applied to lawyers, for personal its 15 days is acceptable Wait for 20 days Write letter to SP and DGP both seeking for help. You can write all these letters in Hindi no English strictly if your not too good. Tip : Advocates do not do this way (they avoid interaction with police) only consultant do , Try to find any consultant or contact me , who ever suggest you not to go police is not your Savior. You guys live in india , no one is going to hang you if you write a letter don't be afraid . My certificates are on hold because i compliant about institute , I wrote a letter they delivered it to my home but for other classmate who don't fallow me gave 5000 to get the certificates. Pl. ref. the very agreement you had entered into. Considering all options - Consumer Commission is the Best remedy which is comparatively less hassled and speedy. The New Real estate law also will be helpful to you in conjunction with the Gujarat Real Estate law. more  
Pay the amount in cheque, take the possession & go for legal action. more
