Salary dispute with an IT organization
I'd joined with an IT firm as Independent Senior Consultant from February 2017. This IT Firm to refuse my invoice against March 2017.
Though, they paid an invoice of February 2017 in end of March 2017 after mutually agree to breach the contract between us and made a promise to pay the invoice of March 2017 in the month of May 2017 but not received any payment except promises. Now, they refuse to pay invoice so what legal option available? How to send a legal notice to the employer? How to file a suit for recovery in a civil court(Bangalore)? more

I get quite a no of emails offering me work at home with a prerequisite of a payment to be made by me to them. If I am doing the work for them, shouldn't it be they who should pay me & if they want a commission, they can deduct it from my initial payments. Online when I do a Google search "company name complaints", I see the websites & the companies itself are fradulently created. I have not found a single one that honestly pays you for the work you have done. more

My comments: 1. Firstly you should go in depth and read the contract (hopefully you have signed one) and understand if there is clause in case of non payment or in case of deficiency of service any party can raise objection and then resort first discussing it out and agreeing on a mutual settlement or taking the legal route 2. At the same time let me assure you the legal route would be very costly for you - probably more than what is due to you - you have not mentioned what is the due amount 3. Please do consider that the current cases (including civil cases - you case would fall in civil case) is pending in courts- and the pending amount is very high - at the district level itself - so if you resort to legal route be ready for a long battle 4. You would be embroiled in court and lawyers - the lawyers - well no comments here 5. Do remember in case you get engaged in a case like this your professional image may also be impacted for any future consulting work - that is a fact 5. My final and a good option to you is after you are convinced the company owes you as per the contract you should adopt the route of "discussing and arriving at a mutual agreement"and move on. Do not resort to filing case based on emotions unless you are sure you would be able to bear the fact that the company lawyers would what is known in legal terms" contest your claims" - you would end up loosing both time and money. more

You are not alone in this predicament. This seems to be not an infrequent practice with many IT firms. This is happening with newly employed as well The HR depts .of such companies are expected to protect the malpractices of the company. And they oblige! My suggestion to get quick results is to expose the name of the company with details on the social media. But these companies know you wont do this because they have a system of blacklisting those who take to social media. more

First of all, you have to clearly indicate the reasons for termination of contract , you said mutual agreement? Since there is no terms and conditions indicated in the contract between you and the company, and if you have left the contract yourself without giving proper notice, the company may not pay to you. Also, you have to produce the proof that you provided your services for the full month of March also, just submitting a invoice does not entitle you to the payment. more
