Seeking legal advise

Person X (petitioner) has sent a court notice to respondent Y at the residential address. Unofficial tracking of the speed post article shows the envelope returned back stating 'insufficient address'. While the postal address is complete in all respect, the returned envelope was received by the court in torn condition indicating the envelope has been opened, documents have been photocopied. There is no official speed post docket number with the petitioner and hence the complaint against the Postmaster seems to be difficult. The petitioner is refiling the petition (as it is understood from the procedure).

While the Postmaster has no doubt conducted in a faith leading to mistrust on the trustworthiness mode of communication by the legal agencies of the country, what are the legal remedies available to the petitioner to pursue the matter in its strictest manner including action against the concerned postmaster and others.

I met SDM recently regarding tons of illegal constructions in our building & I asked her same question about a certain person evading court notices & trying to bribe the postman who had brought speed post to him & despite him at home,he was impersonating someone else ! This summon through speed post was about a Housing scam worth crores or Murder for Property ?? Postman was fuming with anger and he knocked at my door- Dekhiye Madam ,Meri Sarkaari Naukri Chali Jayegi. Help ! I told the postman to be honest with authorities above him that the person despite being at home & aware of Court Summons was refusing to Honor the process of Courts. SDM told me that they have ways of dealing with such people & they take help from the Area SHO. The concerned & affected person should inform the area police that Summons were Not Received. Police complaint along with the summons from the courts will be helpful. These days Courts are making use of email id & this May be a proof of reaching out to the criminal on the run ? more

And my advice to others is that try a person once,pay his/her charges. Give him second chance to do the job for you.

If He Ditches, Refuses to take the Calls, Plays a Pricey Human who fears None & He is bent upon taking away the most precious jewel of a woman,her character & her hard earned reputation,then it is time to be your own master with faith in higher powers above and authorities here on earth. more

Postman's services is another issue and it must be pursued independently of the building scam. Anyway, kudos to you Dr . Neelam Nath for the courage to fight for truth. more

In this case a Court Notice appears to have been tampered with and returned quoting a fraudulent reason. The Court itself can take a suo motu notice of the grave wrong perpetrated by the respondent Y in apparent collusion with the postmaster/postal delivery person and summon them to Court to explain themselves as to why suitable deterrent or salutary action should not be inflicted on them or their action deemed as a Contempt of Court for which they can even be jailed. Moreover for certain recovery cases I have dealt with while in the service of a nationalised bank we have, when notices were returned quoting various reasons "Return to Sender, No such Person etc." we used to display the notice in accepted newspapers, generally one vernacular and one English newspaper, with the permission of the Court and the Bank authorities. Publishing of the notice in a newspaper in this manner is a valid issue of notice and the Court can proceed with dealing with the case. Sir, the respondent will get Scot free as the the fraud has been committed by the postmaster who has written insufficient address. Respondent will always say I was not aware of any notice in transit. Court will not summon post master for the reasons best known. That is the reAso. I am saying breach of trust of the public and public authority for reliable delivery system. more

I once received in my official capacity nearly 23 copies of the same notice from 23 different people from a similar address to build up pressure on me to do something unethical. We replied to all of them accordingly . But may be this could give you an idea how you can get delivered your notice to someone. By the way is it a notice from lawyer or from the court ? as both have different connotations. Lastly it is possible to send by email a notice by using such software that once your notice mail is 'opened' you will get an acknowledgement electronically; though i am not aware how it is done , it's possible as many lawyers are knowing it and using it. Telecom companies are doing it as far as i know; whether it is legally admissible or not is not known. more  
Notice issued from court becomes courts responsibility to take further action on it. Individual issuing notice through his lawyer is responsible for getting it delivered because till the other person does not acknowledge receipt , it is meaningless. The person than has to go to court and then court issues the notice as per their understanding of the case and the need to issue notice to who all. more  
I have been told that for sending the notice agAin one has to refile the case with court fee again. Is it correct and what is the remedy. more
