Seeking the opinion of the members of the group.
The society at present is passing through burning issues of woman viz-a-viz others on the implementation of women laws. One section of the society is feeling deprived of rights of dignified living of women and the other section feel that the present laws itself are draconian and are being abused rampantly. Even the high Judiciary the Supreme Court of India has termed such an Act to be Legal Terrorism, Legal extortion etc. There is no scientific studies available so far and hence the both sections of society are feeling suffering either due to inadequacy of law provisions to punish the guilty or the laws being abused rampantly to settle the scores. The both use and misuse are dangerous for the society to upkeep social values and the family integration and hence we feel that the issue is burning. Women are feeling deprived of their security and men and their family members which also includes women as sister, mother etc. of the men are feeling insecure due to false allegations. The police and other law implementing agencies are alleged to be gaining in the process by way of corrupt practices and insensitive attitude to the society. The legislators seems to be busy in their vote bank politics without any sensitivity to the society. Media has distracted from its ethical obligations due to its own compulsions.
There are two major laws which is affecting both genders of the society, the one being Domestic Violence Act (498a/406), Dowry torture etc. and the other being Anti Rape Laws.
I in association with a NGO of repute propose to conduct a scientific study on the burning issue. I would appreciate if any NGO willing to focus on this burning issue come forward. It is proposed to cover all the stakeholders in the proposed study. I have identified at a glance, the following as the prime stakeholders. The list of stakeholders could further increase as we progress the study.
1. The affected wife of a husband
2. Husband and children of the affected wife
3. Mother-in-law, sister-in-law, brother-in-law, father-in-law
and children
(irrespective of any age ranging from few months to century old) of the affected wife
4. In-laws of the husband of the affected wife
5. Crime Against Women (only Wife) cell (CAW)
6. Mediators.
7. Police
8. Advocates
9. Judges
10. Politicians
11. Women/Men Organizations, Activists, Commission
The study is proposed to be covering areas like Delhi/NCR, all metro cities and Bangalore as the issue is seen to be quite affecting middle and high strata of society. I also propose to take up some rural areas to see whether the laws enacted so far have benefited the women at all or still far away from the realities. The study would be used for a proper advocacy with the concerned constitutional Authorities.
I expect that such a study may take a period of more than a year or so. As you would appreciate that such a study would involve lot of financial support and is not possible to be carried unless and until it is backed up by the availability of the financial resources. Financial support is the only issue which I foresee as a hurdle for non-initiating of the study.
I would seek opinion of the members of this group including AAP party as to whether the members feel the need of such a study for upkeeping of social values, family integration. If the members feel the need of the study, how the issue of financial resources could be addressed. more
