Shops / Studio Apartments in Newtech Lagracia

We have booked Shops / Studio Apartments in M/s. Newtech Shelters, Crossing Republic, C-3, Crossing Republic, NH-24, Ghaziabad, in the Year 2011 with an assurance that we will get Shops / Studio Apartments within 24 months from the booking i.e. before end of 2013 but not get even in 2015. During the time of booking of Shops builder also commitment that there will be a Food Court in the 2nd Floor and we have purchased shops in 2nd Floor because of this.
1. In the beginning (before 20-21 months of signing of agreement) we all the members deposited about 20% of total cost and some of the members also deposited about 70%-75% of total cost.
2. After lot of discussions verbally, through mails and having meeting with M/s. Newtech Shelter’s representatives we have shared our problems and also requested to kindly arrange a meeting with your Director. After lot of follow ups, M/s. Newtech Shelter’s Director ready for having a meeting with selected members only on 9th December 2012 (after 16-17 month). Members discussed on lot of points and also discussed regarding Builder-Buyer Agreement. Director of M/s. Newtech Shelters agreed and also assured that agreement will be done in the month of January 2013 (which is after 18 months of booking of shops / Studio Apartments). In this meeting The Director of M/s. Newtech Shelters also shared verbally that they are providing AC facility in the Mall through some German Technology which is better than AC and will be provided in the same cost. There will be no extra charges for this facility – means included in the cost already.
3. Agreement further delayed and after our lot of discussions / follow-ups with M/s. Newtech Shelters the agreement signed in the month of April 2013 (after 21 months of Booking of shops).
4. During the time of agreement M/s. Newtech Shelters increased the shops / Studio Apartments area and decreased the carpet area. As discussed in the meeting on 12th May 2013 the carpet area of shops should not be less than 70% as discussed and agreed by M/s. Newtech Shelters Representative.
5. We have already made the payment of the shops well in time, if there is any pending payment this is because of shop's increased area and as discussed with Shri Kaji Saheb of M/s. Newtech Shelters during the meeting dated 26th May 2013, Shri Kaji Saheb also agreed that M/s. Newtech Shelters will raise the demand of increased area during the time of possession. But we are receiving the demand letter with increased area also.
6. Most of the members have deposited about 80% payment about one year ago but M/s. Newtech Shelters charging a heavy interest @24% P.A.. M/s. Newtech Shelter had delayed the, If M/s. Newtech Shelter’s project work is running timely then the possession of the Shops / Studio Apartment should be before end of 2013 as promised by M/s. Newtech Shelters at the time of booking of Shops / Studio Apartments and as per agreement which was done after 21 months of booking in the month of May 2015 (20+-6 month). But even after signing of Agreement (which was done after 21 months) and also agreed in the agreement we have not got the possession which should be before 2014 but even after 10-11 months we have not seen any progress that we will get the possession before ending 2015.
7. In the month of September 2015 we have received a bill for AC installation @ 300 per sq ft + sales tax. We all are happy that M/s. Newtech Shelters wants to provide AC instead of German Technology told us verbally, which was better than AC for maintaining the temperature of Mall as per the promise of the Director of M/s. Newtech Shelters. We have requested M/s. Newtech Shelters that if you have changed your decision from German Technology cooling systems to AC please adjust the amount and charge only 50% only. For this we had a meeting with M/s. Newtech’s Representative Shri Tanuj Saxena (Minutes of Meeting Attached) and also confirmed by Shri Tanuj in the meeting that:-
a. The possession of Shops / Studio Apartment in the month of December 2015.
b. AC charges will be charged 50% and 50% amount will be adjusted from the German Technology equipment.
c. As per Government Circular, the charges will be provided to the members @12% per year because the builder charging the interest about @24%.
We all are old associated customer of M/s. Newtech Shelters and again and again requesting the management to consider above facts and pain and take customer grievances on positive sense and reconsider customer request.
We have sent the request M/s. Newtech Shelters for having a meeting and resolve the issue but M/s. Newtech Shelters refused our request. Now our hope from your side that you will help.
NOW PLEASE HELP US:
1. Shops / Studio Apartment carpet area should not be less than 70% as per the Builder’s commitment.
2. Please provide the interest on the payment made excess to the Builder @12% p.a. But now we are asking for 24% because Builder is charging 24% interest p.a.
3. Shops / Studio Apartments possession has been delayed please provide us the compensation @12% p.a. now @24% p.a..
4. AC charges should not be more than @150 per SQFT as per the builder’s commitment.
5. Provide the benefit to the 2nd Floor members because Builder shifted the Food Court from 2nd Floor to another area.
6. Can we get the compensation on the amount which was deposited before signing of Agreement because agreement signed after 21 months.

Builder promised for possession of shops December 2015. Visited site on 3rd January the condition of Mall is not cleared and it will take further 2-3 months.. Please help me so that I can go further. If possible also please provide me a letter so that I can send it to the builder so that I can get the benefit / compensation.
