Should MINOR Projections & Extensions be regularized, without structural changes, imposing heavy penalty ? Please discuss.

In an over-populated city like Delhi, Land is the most expensive resource. Subsequently, unauthorized extensions and projections is a major issue for the State Government. Regularizing colonies (without imposing any penalty) is not a feasible solution to this problem.

For those booked properties (especially smaller plots) which have MINOR Projections (or Extensions, NOT on Municipal Land), should the State Government provide an option to regularize without any structural modifications, by allowing to pay a heavy penalty amount ? Houses constructed on smaller plots generally make full use of the plot area, mostly without any extension on the Municipal Land. This would add on to the State Government's revenue and also avoid any loss of Municipal Land.

And for those booked properties having significant/major projections or extensions, they should be obviously forced to make structural changes to get them regularized. more

For resolving this issue of Minor Projections booked by MCD, in my opinion, below steps should be taken, 1. For smaller plots (less than 100 square meters), 100% coverage should be allowed without penalty. 2. Minor Projections should not be booked in the first place. There has to be a minimum criteria for booking. And to prevent Minor Projections, an alternate rule (imposing hefty penalty without structural changes) should be implemented. 3. For Major Projections and Extensions (whether Minor or Major), structural changes with penalty should be imposed. more  
Regarding our case, we approached MCD people and they (commissioner level people) guided us that it could prove quite expensive (including bribes as and when required) to get the property regularized. And that too is a partial solution, because they cannot remove from the online database, without structural changes. Until the state government changes regulation for all booked properties in Delhi, even those booked for minor projections will equally suffer. When we asked why our property was booked, they said it is all a matter of bad luck. MCD officials randomly visit and book any property as and when they feel like. It was disheartening because our floor plan was the brainchild of architect, who was pretty sure (at the time of construction) that nothing would ever happen for minor projections because first all those properties having major projections would be booked. We changed our floor plan twice (during construction) trying to reduce the coverage at best. But today we stand against MCD with only hope and nothing else. more  
Please note that I agree to the fact that defaulters should not be given any sort of leverage. Kindly read this post and all my comments thoroughly. I am trying to bring this issue forward for only those people whose houses have Minor Projections only (where those projections do not have any impact on the municipal land). Minor projections in smaller plots generally happen due to the false promises made by Architects who mostly misguide to make their own profits and win the confidence of the owners. If Delhi has 100 such houses (those with Minor Projections only), then why only 2%-5% have been booked by MCD ? Should the government not provide justice to these booked properties by giving them the option to pay heavy penalty (for avoiding structural changes) ? I understand that those with Major Projections cannot be allowed to continue with same structure. And I am also not in favour of regularizing colonies without imposing any penalty. Problem is that in this scenario, victimization is done for those who are hardly at fault. Either apply same laws for everyone or for none. Almost all the new constructions in Delhi have minor projections. Hope this clarifies. more  
very often when we are stuck in a traffic jam or a similar inconvenient situation do ponder how we curse the govt and the public for our plight because of illegal parking, illegal construction, occupation of public space etc but do we then introspect how our small encroachments inconvenience other people? we need to evolve as a society rather than individuals more
