SOLD OUT JUDGE
I facing some problem from biased Judge in a small town & petitioners are influential people. They are using unhuman method & judge is showing all SOLD out signs. Some small decisions are gone against HC decisions & guidlines. We are moving to HC for this unjustice. But ....
Should I not defend ourselves & show direct protest?Judge may be asked to give his order totally without defence.
Can it work & raise pressure on JUDGE? Judge is taking advice from petionaer's lawyer & doing all un lawful actions.

to presume that judges are wrong may be an overstatement. You must consult a good lawyer who can critically analyse your case. Godd lawyers usually brig out your weak points and cross question you. Some client feel that the layer is non-cooperative and discard him/her. law like medical science is a holistic subject which may have points of precedence and interpretation. So do not feel that the judge or commissioner is biased. more

Dear Chetanji you have not specified whether you are a practicing advocate or you are one of the litigants. You as an advocate or as a litigant has all the right to bring it to the notice of Principal Judege of the respective district court and the Guardian Judge of the respective state high court by writing a personal letter on your letter head and also through the state bar council office. Additionally you can file a contempt of court petition as rightly suggested by one of our circle's learned member Mr.Atulji Jauhari, in your state high court highlighting the discrepencies and irregularities and injustices being meted out to you and your client. Dear Mr Chetan choudhury, You are not alone in this state. Most of the cases are affected by what you describe. For this the administrative side of judiciary should be strong but unfortunately, the judiciary does not know the fundamentals of management and admin. At least they should hire management consultants to get them out of the mess they are in and thepeople of this great Nation who deserve to get justice fast. more

Please refer to the Judgement of Supreme Court bench of Justice K S Paripoornan, Justice K Venkataswami and Justice B N Kirpal in the case of Dwarikesh Sugar Industries Ltd vs Prem Heavy Engineering Work on 7 May, 1997, in which the court held "When a position, in law, is well settled as a result of judicial pronouncement of this Court, it would amount to judicial impropriety to say the least, for the subordinate courts including the High Courts to ignore the settled decisions and then to pass a judicial order which is clearly contrary to the settled legal position. Such judicial adventurism cannot be permitted and we strongly deprecate the tendency of the subordinate courts in not applying the settled principles and in passing whimsical orders which necessarily has the effect of granting wrongful and unwarranted relief to one of the parties. It is time that this tendency stops." If we find any whimsical order being passed by presiding officer of any subordinate court, against the settled Law, contempt of court can be filed in High Court of that state, against that presiding officer (Judge or Magistrate). more

Correct please. There were S.C. directions advising follow of S.C. findings in settled cases to conclude prompt and fast justice.
S.C. directions of 1997 are also to be set as judicial mandate. Courts not to ignore S.C. directions, Suggestions as the Executive had set in practice .

I do not know whether such practices are prevailing in the courts. Even in the cases adjudicated by the superior courts, the lower courts have ignored the facts. It leads to a suggestion about the need of judicial reforms in the country. more

Unless Judicial Reforms mandated as concluded in our Circles ; Unless a Procedure is formulated for different issues that tender [1] Purpose, Objective and Concept of that particular law/Article to find in Justice for all issues of Civic Society [2] Definite and un-deviated/undiluted Strict and Stringent Punishment and imprisonment for any Sorts or Criminal Offences on Text bases verdict [3] Definite and multiplied Punishment and imprisonment for any Financial Crimes relating to Government Funds and Public Finances ; REAL JUSTICE CANNOT TAKE PLACE IN MANY ISSUES . Particular law and Specific Section cannot discriminate the award of Justice out of its object, concept and purpose . The Law is same for every lawyer or Reader of a Law . A Judge from a Sub Court is not a direct recruitee and so, Every Judge is to be with the Capacity to deliver Justice of that particular law and that specific Section . Citizen shall not be deprived of justice and even his equal opportunity and there shall not be any discrimination EITHER OF ECONOMIC CAPACITY OR, LITERACY as contemplated in Article 39 A which was set under the concept of Preamble of our Constitution.
