Suggestion for solving property disputes
1) The practice of undivided share of joint owners in a property should be banned.
2) At the time of purchase of property, if the property is being bought in joint names, each owner's clearly divided share in the property on map as well as in writing should be registered. Also, registering nomination details of the new owner(s) (buyer(s)) should be mandatory. In case of more than one nominee, each nominee's clearly divided share in the property on map as well as in writing should be registered. Nomination deatails should be kept confidential.
3) In case of all existing properties (even if not being sold) having joint ownership, it should be made compulsory for the joint owners to decide and register clearly divided share in the property on map as well as in writing. If they are not able to decide themselves, the government should divide their share on the basis of a predetermined criteria and register it.
4) For owners of all existing properties (whether individual or joint), registering nomination details of the owner(s) should be mandatory. In case of more than one nominee, each nominee's clearly divided share in the property on map as well as in writing should be registered. Nomination deatails should be kept confidential.
5) After death of any registered owner, his/her share in property should be registered in the name(s) of nominee(s) as per nomination details and at the same time, nomination details of new owner(s) should be registered. In case of more than one nominee, each nominee's clearly divided share in the property on map as well as in writing should be registered. Nomination deatails should be kept confidential.
6) Owners should have an option of changing their nomination details anytime.
