My husband received a tax demand 2 years back which was wrong in first place. For last 3 years they kept deducting his tax refund against the demand. Finally this year the demand was removed. How should be get the refund money deducted for previous years, back from authorities? more
Again i wud say that why not to discuss with itax dept. officer face to face and ask them about your problems. it is safe to see the itax dept. officer of concern zone. more
To give correct advice pl. provide full details i.e. demand for which assessment year and amount.PL. UPLOAD scanned copy of demand and return and computation of income of the coresponding year. more
You need to provide the following information to get any meaningful advice: (a) Reason for raising demand in first instance and action taken by you to challenge the demand itself. (b) If the incorrect demand was because of an error apparent on record, a rectification application was to be filed. In case the incorrect order could not be rectified then appeal had to be filed before the Commissioner (Appeals). Was any of the process initiated? (c) Before adjusting the refund against the demand a notice is sent and online facility is available to respond to the notice. In case your reply is accepted no deduction is made from your refund. I have successfully got refunds for my wife for last three assessment year when her appeal was pending. (d) For Assessment year 2015-16, the refunds have been released without adjustment against pending demands where amount involved was less than 5000/-. You can view the pending demand and the underlying computation online after logging in your account. more
One cannot make out clearly from the text of your query whether the total demand has been met out of refund amounts due year after year or it has been suddenly removed. Normally, the interest components keeps on mounting year after year on account of non payment of demanded amount. more
If the demand was wrong, you should have written to your ITO for rectification of orders. Since you failed to protest incorrect assessment, they had adjusted the future refunds. You may still write for rectification of incorrect assessment order more
