If the property was partitioned before the death of the elder brother,his share is his separate property which will devolve on his legal heirs including daughters, after his death intestate(without any Will) but it will be ancestral property in the hands of his legal heirs. more

Yes, the property is the elder brothers individual property and his children /wife /mother will have a claim if he has died without a Will. more
