The new Consumer Protection Bill

Appears that the efforts of Consumer Dept and these circles could get a big boost with the Consumer Protection Bill getting approved. After that, the following could happen:

Manufacturer or service provider making false or misleading advertisements will attract imprisonment for up to two years with fine up to Rs 10 lakh or five years imprisonment with fine up to Rs 50 lakh.

Those manufacturing, selling, storing, distributing or importing adulterant goods, resulting in the death of a consumer, can attract punishment up to life imprisonment and not less than seven years and fine not less than Rs 10 lakh.

In case of serious injury, the punishment is up to seven years imprisonment and fine up to Rs five lakh. In case of injury, the punishment is imprisonment up to one year and fine up to Rs three lakh.

In case of no injury, the punishment is imprisonment up to six months and fine up to Rs one lakh.

For those convicted for the first time could face suspension of license for up to two years and those convicted for second or more time can face cancellation of license.

If a product causes any harm to the consumer then the manufacturer will face liability even if he/she proves he/she was not negligent.

A manufacturer/producer/seller will be held responsible for any injury or death of consumer caused due to issue in manufacturing, design, warning, labeling, instruction, packaging or marketing.

A powerful Central Consumer Protection Authority will be formed to investigate into issues related to violations of consumer rights, unfair trade practices, and misleading advertisements.

The bill demands to form of Consumer Dispute Redressal Commissions at the district, state and national levels.

All these bills and acts are good but the pendancy of complaint cases is taking very long time to be addressed. Whereas the Consumer Protection Act the limit for disposal of complaints is six months but it takes more than 4-5 years the complaint to be settled that is my experience at least in Delhi

There are too many complaints pending. It takes months to fill the vacancy of Members and President of Consumer Forum. The number of Consumer Forums is far less than is required I narrate my personal experience

I filed the complaint against General Insurance Company in 1913 in one of the consumer forums in Delhi. The last adjournment which I got is for 10 months to May 2018 which is more than any civil cases in District Courts

Will it be really implemented or it will remain on paper? We have had a very bad experience of GST. It may be a new attempt to divert the consumers attention. Govt. has failed to protect the consumer's interest. Let's hope Govt. is serious about it and frame mechanism appropriately. more  
Rules are essential. This is good news. Implementation is another point. Both should come together so that implementation of rules become easy. more  
Making of the laws is a pastime and just to impress the citizens. Look at the Consumer courts, the proceedings take so long that people tend to avoid doing anything in spite of all kinds of nuisance going on around us. Many of the litigation are just repetitive in nature. Like disputes with Builders can be avoided if an uniform Flat buyer's agreement format is introduced, but I doubt even with RERA it has been done. It took me 7 years to win a case in State Forum against Unitech. Now it is in National forum and will take another at least 2 years for the final verdict. It's an open & shut case and could be solved by the OC of the P.S in 1 Hour if our system had been pro-consumer. The whole system is anti-consumer, otherwise why an ex Police Commissioner will be one of the Directors of the Company and that is why in India the laws are for law-abiding citizens, for the Offenders they make their own laws. You must have seen the recent incident of Ram-Rahim which shows how he prospered under the umbrella of Administration and became a menace for the country. God save us. more  
Its good but the main thing is its implementation religiously and bribe free environment. more
