I am a director of a pvt. limited company (previously a Partnership Firm) formed in 2012. All our Income Tax Returns with PAN no. AAECD3459P and VAT Returns were filed regularly with no hassles. While migration from VAT era to GST era , I received a GST No. 19AAEFD9958Q1ZC which showed that all VAT returns filed during 2012 to pre GST period were filed under Partnership Firm constitution. That meant there was no complete migration from partnership firm to pvt. ltd. company. I applied for a fresh GST No. under our company's name , due to some reason or the other , we could not get a fresh GST no. Finally , we thought we would file all GST returns under the GST no. we earlier received though there is a mismatch (IT returns under company and GST returns under partnership firm). The problem now is that the person filing VAT returns has lost the Email ID & password for the GST No. we received. Now I am in a terrible situation - the late fine I would have to pay is just huge. The more important aspect is the Cash Memo is showing our establishment's name under company's name and the GST No. is under a partnership firm. I just cannot avoid issuing a Cash Memo to the customers. I am in a full trouble. Please guide and help. more

My view is to apply for new number of GST under your Pvt. Company name. Could you tell me the reason of not granting of registration number of your company? If you deposit the tax under GST with your firm GST number then it will create a problem to you in future. As your income tax turnover and GST turnover of your company will not be reconciled. For VAT issue you can handle with the department separately personally as this issue can be resolved as there is no payment of tax on your part. more
