Undue Harassment by Police: Inputs Sought

Yesterday, the founder of a startup was arrested by police in Chennai for a case of defrauding, filed by one of the startup's vendors. Some media reports suggest it was an unwarranted arrest.

With this post, we would like to seek your inputs on the various harassment citizens face from the police in India. The objective of this discussion is to understand how laws are misused by the police against citizens.

Once we have a better understanding of all issues, we will have a separate discussion on root causes and solutions.

The ordinary comment is "Police is honest and efficient, this is the politicians who make them corrupt and inefficient to fulfil their wishes" , I beg to deny & say "Who asked them to fall in line with corrupt & dishonest politician"s wishes & become dishonest & inefficient? Are they not paid their salaries for work?who asked them to follow appeasement policies to satisfy dishonest politicians ? . Are they not constitutionally service guaranteed officers?Donot they know before joining police service as to what police service is & risks associated with it?"... There are no answers to these questions, In the past a number of honest, brave , highly morally ethically , subject knowledge-wise strong , straight forwards officers of other departments who never cared selfish, dishonest political bosses were brutally, mercilessly crucified by certain cruel /corrupt incompetent police officers, (including some of top IPS selfish cadre also at the behest of certain dishonest political bosses or by corrupt police itself).Had these police officers been straightforward in discharging their duties, the present situation might not have been come to the present stage!. Indeed this is the excess /undue importance, official & unofficial pay & perks given to them made them counterproductive & act against the interest of general public from whose pockets of money ,they make their livelihood, against whom they are now showing ingratitude! "Ingratitude is more powerful than traitors"s arms"-- It is the right time now to show the correct place where these corrupt & incompetent police should be!The situation in the matter of efficiency &integrity of most of the police personnel including a number of top ranking cops like Pricipal secretaries(Home -police) to Government is far far below satisfactory levels because of rampant corruption, favouritism, nepotism & incompetency coupled with high degree of arrogance, contempt for the common man, in both the Telugu States of Telangana & Andhra Pradesh . ACB department ought to be headed by a honest , dynamic, competent Senior IAS officer of the Rank Addl . Chief Secretary to Government instead of a Senior IPS officer in the Government as a matter of principle of propriety, as a part & parcel of prudent administrative practices like "Seggregation of Duties"which practice is not being followed in a number of states including Andhra Pradesh & Telangana States ,since there a number of "Black sheep" among IPS officers without any amount of responsibility, accountability, etc whatsoever for the blunders committed by them in Govt resulting financial loss/ retardation of productivity in the country ( Dedicated,dynamic, competent , honest, diligent Sr IPS officers'number is small) exists, who tend to protect their own delinquent cadre. Adding fuel to the fire, the Central Govt recently brought new liberalized rules in favor of AIS (All India Service Officers) that the warnings., memos etc given to delinquent officers who turn out bad work in discharging duties will not be a hindrance to their promotions . Unless "Good Governance" is ensured in running both the Central Govt & State Govts, in Our Country, no amount of good reforms like the present day " de-monitisation programme "or the supreme sacrifices of people would be of no use & would hardly deliver fruitful results to public . I donot have any hope positively (improvement of corrupt/incompetent bureaucracy/judiciary, since I could not find not even 0.00000000001% improvement in efficiency of police depts since ModiSab"s Government came in to power-honestly speaking)) that the Govt machinery will be pepped up to offer quality services to common man or needy individuals in the next 5 years also,unless great miracles happen!Now the Country is almost full of artificiality, false promises, lies excepting in rare situations (Bait & switch selling practices) etc! we cannot unduly punish the genuine citizen"s financial requirements & tax heavily on such class of people. What ever may be the outcome , may be mix of sweet or bitter tastes, the steps taken by Govt ought to give lot of solace in the long run to the common man ,fed up with corruption & bungling in most of the crucial decisions by Bureaucrats particularly certain incompetent & corrupt cadre of IPS/IAS cadres and next agenda of the Govt ,it is requested to weed out such rogue Bureaucrats on war footing like this demonetization scheme particularly certain incompetent & corrupt cadre of IPS/IAS cadres in in the Country including all state Govts,the corrupt pygmies masquerading as great Heroes/Heroines who sit on the files for years /decade together& cause enormous loss/lot of detriments /hardships to genuine citizen from whom they draw their livelihood/salaries etc in the form of taxes. It is a matter of pity that certain Principal Secretary (Home ) level officers either sit on files for years to -gather or make misleading remarks , narrating cock&bull stories ,mislead the Hon"ble Home Ministers to compel the Home Minister/CM to take wrong decisions.There is hardly any accountability/check to such rogue Bureaucrats,now (since I am presenting a certain "live" situations and not hypothetical ones in the Andhra Pradesh Government ) & the situation is not far different in Andhra Pradesh also, though the State is headed by a retired IPS officer,as Governor & most of the opposition parties are craving for his recall by Central Govt.No responsibility nor accountability for incompetent actions , the burden of which is to be carried on by tax paying poor citizen. Also a system in all Govts may be evolved to give an acknowledgement compulsorily to the complaint of petitioner/ from public against any bureaucrat & the status/action taken by the Govt could be informed to petitioner with in a time frame of 3 months., which process is also likely to reduces the possible avoidable litigation s in various legal Courts. and also ensure smooth & efficient functioning of Govt machinery.This immediate action needs of reforming incompetent to be taken by Central Govt as in the case of dynamic action of "Demonetization of 500 & 1000 Rupees Notes" taken by Central Govt recently.& comfort to common man.Let the "kind cruel Knife of Hon'ble Shri MODIJI" ( like the kind cruel knife of a surgeon for the betterment,well being of an ailing patient) be on the reformations of corrupt , incompetent,dishonest Bureaucracy on war footing , which is causing more harm than the "BLACK MONEY & FAKE CURRENCY" now curbed, in larger interests of Nation.Single step would yield limited results, but pruning the corrupt bureaucratic system as well as stalling the "BLACK MONEY & FAKE CURRENCY" yields excellent results to the economy.In the past a good number of very honest, efficient brilliant INTELLECTUALS/PROFESSIONAL MANAGERS in Govt & public sector were & are even currently also, are brutally victimized for their integrity, efficiency by some of the corrupt bureaucracy & incompetent judiciary, either by marching orders or confined to prison even for no fault of theirs & their families are languishing virtually on roads, Who showed pity /sympathy on them?Did the bureaucracy at the helm of affairs?"Charity begins at Home " & " Dharmo-rakshathi Rakshathaha" , which were never practised by powers which are /were in helm of affairs. It is the same bad path that was developed by corrupt bureaucracy & incompetent judiciary, through which Shri Gupta has now to pass through.Every dog has its own day. . A good procedure ought to be mandatorily applied in state governments also with stringent punishments for dereliction of duties to erring officers, even applicable to all AIS officers including some IPS officers holding the of Principal Secretaries to Concerned Home Departments ,who consider themselves as monarchs & either delay files or put misleading remarks for more than 7 to 8 years to the detriment of poor taxpaying common man who approach the Govt for Justice with fond hopes ( I know live cases in AP Govt where the file disposal position is pretty bad, while the Common Governor of Andhra Pradesg & Telangana states compliments the performance of AIS officers, that every aspect is quite good, hopefully with an optimistic approach since he himself is a former Sr IPS officer who hardly is aware of the woos of common man, while the Union Govt believes the same with utmost faith;for ex in the present Nayeem -Gangsters's extortion cases, his susequent encounter, the reported information that came out to public that several IPS officers &politicians are in support of him in his illegal activities etc) without fear or favor. more

We go to a hospital for proper diagnosis and effective treatment of our ailments. Any regulation that can help implementation of prompt and effective treatment is welcome . Charges should be tailored to the patient's ability to pay. A famous hospital in Bangalore charges for routine visits of doctor to in- patient' s bed Rs 500 daily. Separate charges for hand sanitiser,cotton roll and gloves. In any case Govt . Should attempt to provide national health insurance on top priority basis. Nori Venkateswarlu. more
