Uniformity of the circle rates of the properties in Delhi

One of my friend has shared an email sent by him to the Chief Minister of Delhi and I found it to be relevant as the circle rates seems to be irrational. On the one hand where the circle rates in posh colonies are less than the market rates, it become a source of black money and on the other side where the circle rates are higher than market rates in backward areas, the buyers are being charged higher stamp duty. Is there any solution as the person has been requesting Delhi Government for rationalisation of the circle rates but without any success so far.

"This is my grievance against irrational circle rates of properties/ flats in Delhi since 2012. After many complaints were filed, Delhi govt constituted an expert committee for revision of circle rates which submitted its report in March 2014 recommending prompt rationalization of circle rates, more particularly circle rates of flats which are uniform across the city without any categorization of area or location of the property. Thus Circle rate of LIG flat in Keshav Puram (Category F) or Narela (category G) is same as LIG flat located in Vasant Kunj or Munirka (category C). It is significant to note here circle rates as notified by MCD vary from Rs.40,000 per sq. mtr. in category H to Rs.5,00,000 per sq. mtr. in category A1 for charging property tax. Since circle rates of flats as notified by revenue department of Govt of NCT of Delhi are uniform across Delhi, stamp duty charged on same area flats is same throughout Delhi whether the flat is located in backward area e.g. Narela or posh colony e.g. Vasant Kunj. Thus in backward areas circle rate is much much higher than market rate of property and Govt is (illegally) charging much higher stamp duty on each sale/purchase transaction. On the other hand circle rate of similar flat in posh colony is much lower than market rate and purchaser is happy to pay lower stamp duty on the basis of circle rates, the balance amount is paid in black. As such the government is losing revenue and is responsible for generation of black money. Further in backward areas where circle rate is high, nobody is willing to buy flat and govt is again losing revenue by way of stamp duty. Expert Committee which submitted its report in March 2014 also recommended fixation of circle rates of flats on the basis of category of location. But its recommendations were ignored and another committee constituted after many complaints were received by the govt which has also submitted its recommendation in 2017 for quick revision of circle rates. Although Govt has ensured logical revision but no action taken during last 12 months for rationalization. Please do the needful at the earliest as it is a matter of larger public interest."

The members may like to submit their views and comment on the issue which seems to be of larger public interest and Govt of Delhi take appropriate action after pursual of the valueable comments of the esteemed members of this local circle community. I would also appeal the Administrator of the circle if required to carry on a poll based on the comments received. more

State wise stamp duty rates be replaced with one rate as done for GST. Different slabs for different categories should be reviewed. Nation wide rate of 5% is reasonable considering cost escalation of real estate. more  
Stamp duty rates are much too high, thereby forcing evasion by understating values of properties. It should be a uniform 1% of the transaction value, irrespective of area. This will rule out elements that induce corruption, and people will happily pay that amount. The problem with state govts is that they look for any opportunity to TAKE from people, rather than GIVE them service for taxes and other levies charged from citizens more  
My submission for circle rates is that Circle rates should be at par with Market rates,this will discourage Black money involvement in property sale purchase,thus reduction in corruption and black money generation. more  
I totally agree with concern raised by Dr Neelam Nath ,all Govt agencies are deaf & dumb to this encroachment more  
How can we expect rational circle rates when the real estate business is grooming on un-real values and on the principles of capitalism and corruption. Banks have been extending loans to individual collecting regular EMI from these individuals and pass-on the funds to builders without asceratining the construction status and thereafter, Banks make the individuals "DEFAULTERS" if these are not able to pay EMI in the absence of possession of the house in the agreed timeline. more
