Update on Petition on Punishment for Child Rape

Based on the consultations we have had with Central Government, human rights organisations, and studying Law Commissions report of only permitting death penalty in cases of terrorism, we are proposing a slightly different approach with this petition.

Our Ask of the Central Govt will be to amend the POSCO act so punishment for child rape is Life Imprisonment without parole. To that order, we will be changing the petition header to "Join hands to demand life imprisonment without parole" for child rape.

We will continue to pursue the Ask for Death Penalty at State level, since Rajasthan, Madhya Pradesh, Haryana and Arunachal Pradesh have already passed a bill to this effect.

In addition to the approximate 1900 signatures on online petition, we have received over 8300 physical signatures from over 15 states of India.

Democratic,human civilised punishments are to be removed and replaced by punishment appropriate for the crime irrespective of age. more  
Any ambition/Coercion/ Rule which is against to the Human Natural Qualities based on Hormones IS INHUMAN and also ANTI UNIVERSAL MANDATE. Control of natural demand of Hormones creates criminal and unlawful attitudes and is why English Law made many exemptions giving off Female Sanctity and Modesty too . This is not wise to practice at human morals . FUNDAMENTAL FIRST STEP IS TO ELIMINATE ALL means and exemptions of instigation and provocations of Sex and indecent presentation and re presentation of Women while changing the IPC relating to Sex and Rape removing Exemptions under Consent and Connivance . THE SECOND STEP IS TO MANDATE Death Sentence besides compensations ; Life Sentence besides compensations and, 7 years Sentence besides compensations to the Families of the Victims considering Rape and Unlawful Sex cases mainly from Lovers AND , the Related . more

The various viewpoints point towards a debatable situations. One is where to place the age of a Minor? Is age of a Minor really a yardstick today (let's not forget Nirbhaya!)? A Minor today is capable of any crime. One also hears of criminals after coming out from jail sentences of more than even ten years, and committing the same crime again shortly after release. So? On the other hand, would death penalty provide a permanent solution? There's death penalty in Singapore, Malaysia and Indonesia for drug trafficking. Since decades dozens of youth have been hung to death for this crime in these countries. But the trafficking continues ...........they all think that they would not be caught! History has written about cases where criminals were run through a long razor until cut into two pieces at the end of the 20 or 30 yards. Hands of thieves were cut, meaning, their limbs that committed the crime were removed. Shaming of criminals in public, viz. making them walk naked in the area of their residence, has also proved as effective deterrent. Example: Littering is a punishable offence in Singapore. Those caught littering are made to wear a jacket with "I have littered" printed at the back of that jacket....they are then made to clean up roads as punishment, are video-filmed and these videos are shown on the local TV channels; names and addresses of the culprits including their faces are shown boldly one the TV screen. Now, raping is a much more severe crime. However, these examples may help the Indian authorities to choose one or a combination of punishments to find a solution to the menace of raping.... One thing should be clear: We humans do not learn good behaviour "willingly"; we need the "sword of damocles" hanging over our heads for us to behave.......we shall continue to behave as "spoilt children" unless the rod comes down upon us..... more

Female of 11/12 ; Male of 13/14 possess potentiality of Sex Hormones and are also Matured in general. English Laws also recognized these Ages . IT IS UNWISE TO GO AGAINST NATURE . more  
CHILD RAPE AND MINOR RAPE IS BEING TAKEN VERY LIGHTLY IN THIS COUNTRY. PERHAPS THIS IS A PLOY TO PROTECT THE "HIGH AND MIGHTY" SINCE MOST RAPE CASES INVOLVES A DIGNITARY OR AT LEAST HIS/HER RELATIVE. THESE PEOPLE KNOW THAT ' THEY CAN TWIST THE INDIAN LEGAL SYSTEM AND ESCAPE AT THE OPPORTUNE TIME'..!!..THIS SHOULD NOT HAPPEN.THUS I SUGGEST THAT OUR LAW SHOULD BE FORMED AS FOLLOWS: 1) RAPE OF A MINOR( AGED LESS THAN 15 ) SHOULD INVITE DEATH PENALTY WITH A PROVISO THAT THE CASE SHOULD BE COMPLETED WITHIN 30 DAYS AND EXECUTION TO BE COMPLETED IMMEDIATELY. 2) ENQUIRY OF ALL RAPE CASES SHOULD BE COMPLETED WITHIN 60 DAYS FROM THE DATE OF FILING AND NECESSARY PUNISHMENTS SHOULD BE HANDED OUT WITHIN 72 HOURS OF THE COMPLETION OF THE TRIAL. 3) ALL ACCUSED IN A RAPE CASE SHOULD NOT BE GRANTED BAIL UNDER ANY CIRCUMSTANCE. more
