per Section 9(1) of The Income Tax Act if the value of the Indian assets is more than 50 per cent of the global assets, the shares will be deemed as Indian shares and gains if any will be liable to tax in India. Now that the rules are clearly written out, in any such transaction the 50 per cent threshold is looked at and depending on the outcome and other factors such as treaty benefits, etc the taxes are being paid and applicable reporting is also being made.

We need not bother about what Walmart is going to do. Our concern should be what our Income tax department is going to do. Will they use all the rules to collect the tax or will they join hands with walmart to find out some loop holes and avoid tax their by benefiting walmart and also themselves. more

well its only fair that any biz is taxed in the country and as per the laws prevailing there on the revenues made there!! well may be this might fall closely to mirror the wealth creation paradigm also.....where capital assets are involved for after all the capital assets also accrue and grow in the country that they are created IN!! but even so, they may find the 125 crore "GALLOPINGLY economically progressive population" of the indian consumer market a 'gold field' to mine TO TAP INTO!!although i must say that.....even the US may not have thrown open its doors so widely to immigrant companies to do 'free biz' when they were building their nation some 150 years ago!!!!!!!!!!!!!!!!!!!! even now, 'immigration policy' is really a BIG THING......QUITE A BIT OF RESTRICTIONS AND IMMIGRANTS ARE ALLOWED TO ADOPT JOBS WHERE A NATIVE AMERICAN CANNOT BE FOUND TO DO THE SAME JOB!
