We are a group of 18 persons purchased plot (s) from a construction company. At the time of registration we had an agreement with them that the construction part will be completed by them as per the lay out / plan / specification etc and would be completed within 18 months. Where as the work was not completed even after 06 years and other amenities, infrastructures etc., have not been placed till date. Since few months 3 persons started occupying the villa and some of the work in other Villa is going on. Because of the delay in construction some of them have not paid complete payment. Now he is threatening that he will close the main gate and side gate after one month if the parties are not paying the dues as the common land is not registered under society or to individual name. Secondly as per contract there is no provision for waste disposal and when we requested he said that can not be done as this is not in the contract. What could be the remedial action to be taken. kindly advise on the above points. more

send a legal notie of 15 days and seize the construction company office also ladies should be in that system not only mens , if females were seize the property police can do any thing but to negotiate with builder more

Sashidharan M , Sir , Your group of 18 persons are hopefully law-abiding and aged enough to be aware of how dangerous it is to have dealing with Builders / Real Estate /Construction Companies from the beginning itself without an idea of basic legal logic and avoidable consequences of the deals . Tough times are ahead for all those entering into immovable property transactions like selling & buying as owners and for ownerships prima facie when they don't take legal advice at the beginning itself and engage practising legal professionals of Law in the related relevant fields to ensure completion of the deal . Even now , not too late at this stage . It is better to appoint a Lawyer for this Group to take precautions and needed steps as early as possible rather than developing cold feet to do so . To reduce the forthcoming legal expenses , it is advisable to look for a Lawyer / Advocate who is already in this field situated in nearby area so that travelling expenses will be small. Secondly , take a minor precaution that that Lawyer / Advocate has no relationship with the Construction Company in question . more

unless and until sale deed terms and conditions are is not read it is not possible to advise u correctly in the matter. Further civil suit can be filed filed by the sufferer. more
