It appears that all regulatory approvals were given for the project even then a PIL was lodged in Supreme Court.
High Court and Supreme Courts are now being approached by a group of diehard dissenters in the guise of civil society or a political outfit through misuse of PILs on matters other than Legal issues.
Supreme Courts observation is very apt that “HCs can’t turn superlative authorities through PILs”.
Misuse of PILS results in delay of projects being implemented, project cost escalation and waste of time and money to fight the case in High Court and Supreme Court.
This raises a very important issue “Who is Governing the Country”?
Laws passed by Parliament and approved by President are being challenged in Supreme Court eg. CAA and Farm Laws.
Perhaps a law is required to prevent misuse of PILs by fine and imprisonment for frivolous PILs. PILs against projects are used to extract money from project proponents. more
