What are the obstacles for adopting Uniform civil law in India ? We need to establish Uniform law , so that every Citizen will enjoy same law and status in Country . Different laws , acts, differentiation are dangerous for Integrity of Nation . Political will is required to change the system . Now BJP has large mandate and majority . BJP has to take step towards Uniformity . How much time it will take to make this Country free from differentiation , free from the system which is based on religious beliefs . How much time it will take improve law system . Please state your views . more
Uniform in my view is the law which is equal for all citizen . All justice , all facilities should be given without any discrimination . No one will be considered minority, no one will downtrodden , no one will be superior, no one will special , everyone will be Bhartiya and will have equal status in the view of law or Government . Poor and incapable citizens will be uplifted irrespective of caste race and religion . more
1. Uniform Civil Code has its own legal Sanctity and Mandate binding all Citizens to upkeep Uniformity in Civic treatment in terms of Safety, Security besides Welfare and livelihood requisites which are bound under Humanity, Morality and Natural Justice . This entitles Equality in Rule by a Country and provides, carries and sustains Equal Opportunity irrespective of Religion, Race, Caste, Creed and Gender to Live Safely and with Secured Systems of Civic requirements. This i.e., UNIFORM CIVIL CODE is absolutely required to be maintained in any Country and is why, the Supreme Court in 2017 DEFINED THE JUSTICE IN A COUNTRY AS THAT " Justice, Morality, Humanity and Goodness " as to be prevailed with Natural Justice . The issue of Natural Justice was wisely defined and concluded by the S.C. through their Judgment AIR 1983 SC 130 ibid.at P.142 that the day will come very fast to upkeep the NATURAL JUSTICE in all matters of Rule in a Country AND HAS BEEN BECOMING TRUE 100% . 2. The issue of FREEDOM OF RELIGION that was clearly Provided under Articles 25 to 28 which also endowed liberty to follow any Religious Belief and practice IS DIFFERENT FROM THE AMBIT AND ORBIT OF Uniform Civil Code . No Religion will be permitted any Belief or Follow which is against to the Human Norms , Natural Justice at Equality , Morality and Goodness of Livelihood requirements of Safety, Equal opportunity, and Secured Living and Leading of the Families of every Human Being. EVEN INDIVIDUAL RIGHTS AND LIBERTIES ARE SUBJECTED TO CERTAIN RESTRICTIONS AT THIS PRINCIPLE OF RULE OF A COUNTRY as also were incorporated in our Fundamental Rights Article 19 with specific Clauses , 2 to 6 . Even the Religions of India , our Home Country WERE SUBJECTED TO THIS CIVILITY, HUMANITY and MORALITY CONCEPT and, the Religious Beliefs of these Indian Religions also were Prohibited , Curbed and Controlled AND , WERE ALSO REFORMED ARRESTING Polygamy, Related Marriages etc., while introducing WIDOW MARRIAGE SYSTEM just for this cause of Civic Bindings . 3. SO, UNIFORM CIVIL CODE WILL STAND AT Justified Human Morals and demands of Civility and Civic Sense at large . more
I am not expert in this field. But I think, since freedom of religion is the fundamental rights given by the constitution of India, it is difficult to get uniform law on religious matter. However, uniform law prevails in other matters like crime, etc. more
